Terms of Use
Terms of Service
These Terms of Service apply to your use of the 1st 4 Signs website and to orders placed with 1st 4 Signs Ltd.
1. About Us
This website is operated by 1st 4 Signs Ltd. Throughout these Terms, references to “we”, “us” and “our” mean 1st 4 Signs Ltd.
We operate this website through the Shopify ecommerce platform, which provides the online systems used to display and sell our products and services.
By using this website or placing an order with us, you agree to these Terms together with any other policies referred to on the website.
2. Using Our Website
You may use our website only for lawful purposes. You must not use the website in a way that could damage, disable or interfere with its operation, security or availability.
You must not:
- Use the website for unlawful or fraudulent purposes
- Transmit viruses, malicious code or harmful software
- Attempt to gain unauthorised access to the website or associated systems
- Misuse, copy or reproduce website content in breach of intellectual property rights
- Use automated systems to interfere with the normal operation of the website
3. Products & Product Information
We aim to describe and display our products as accurately as reasonably possible. Product photographs, colours and finishes may appear differently depending on screen settings, lighting and the characteristics of individual materials.
Natural materials such as slate and timber may contain variations in colour, texture, grain, markings, surface finish and edges. These natural variations form part of the character of the material and do not necessarily indicate a fault.
Measurements may be approximate where this is stated on the product page.
We may update product descriptions, options, specifications or availability where necessary.
4. Personalised & Made-to-Order Products
Many of our products are personalised or manufactured specifically to the details supplied by the customer.
You are responsible for checking that the personalisation information you provide is accurate, including names, dates, numbers, addresses, spelling, punctuation and other wording.
Where a design proof is provided, you are responsible for checking the proof carefully before approving it. Production may begin following approval.
If no specific layout instructions are supplied, we may arrange the information provided in a professional layout appropriate to the product.
Once production has begun, it may not be possible to change or cancel a personalised order.
5. Orders
Placing an order constitutes an offer to purchase the selected goods. An order is not necessarily accepted until we have processed it and, where applicable, commenced production or confirmed acceptance.
We reserve the right to decline or cancel an order where there is a legitimate reason to do so, including where:
- A product is unavailable
- There is an obvious pricing or listing error
- Payment cannot be authorised
- The personalisation requested cannot reasonably be produced
- The order appears fraudulent or unlawful
- We are unable to deliver to the address supplied
If we cancel an order after payment has been taken, we will refund any amount due for the cancelled goods.
6. Prices & Payment
Prices shown on the website are those displayed at the time of ordering, subject to correction of obvious errors.
Delivery charges and any other applicable costs will be shown where relevant before the order is completed.
We may change our prices at any time, but changes will not normally affect orders already accepted except where permitted by law or where an obvious pricing error has occurred.
Payment must be made using one of the payment methods offered during checkout.
7. Delivery
Delivery estimates are provided in good faith but are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, although this does not affect any rights you may have under applicable law.
Customers are responsible for providing a complete and accurate delivery address.
Please contact us promptly if an order arrives damaged, incomplete or appears to have been lost in transit so that we can investigate and provide an appropriate remedy.
8. Returns, Cancellations & Refunds
Returns, cancellations and refunds are subject to our Returns Policy and to your rights under applicable UK consumer law.
Certain personalised, custom-made or made-to-order goods may not qualify for the standard cancellation rights that apply to ordinary distance purchases, except where the goods are faulty, damaged, not as described or another legal right applies.
Nothing in these Terms is intended to limit or exclude any statutory rights that cannot legally be excluded.
9. Faulty, Damaged or Incorrect Goods
Goods supplied to consumers must meet the standards required by applicable consumer law, including being as described, of satisfactory quality and fit for their intended purpose where relevant.
If you believe an item is faulty, damaged or incorrect, please contact us with the relevant order information and, where helpful, photographs showing the issue.
We will assess the issue and provide the appropriate remedy in accordance with your legal rights and our Returns Policy.
10. Customer-Supplied Photographs, Logos & Artwork
Where you provide photographs, logos, artwork, text or other material for use in a personalised product, you confirm that you have the necessary rights or permission to provide and use that material for the requested purpose.
You must not ask us to reproduce material where doing so would infringe another person's intellectual property, privacy or other legal rights.
We may refuse artwork or wording that we reasonably believe is unlawful, infringing or otherwise inappropriate to reproduce.
11. Intellectual Property
Unless otherwise stated, the content of this website, including text, graphics, layouts, photographs, product imagery, branding and website materials, is owned by or licensed to 1st 4 Signs Ltd.
You may not reproduce, distribute or commercially exploit our website content without permission except where permitted by law.
12. Third-Party Services & Links
Our website may contain links to third-party websites or use services supplied by third-party providers.
We are not responsible for the content, availability or privacy practices of third-party websites that are outside our control.
Your use of third-party services may also be subject to the terms and policies of the relevant provider.
13. Website Availability
We aim to keep the website available and functioning correctly, but we cannot guarantee uninterrupted or error-free access at all times.
We may temporarily suspend, update or modify parts of the website for maintenance, security or operational reasons.
Nothing in this section affects rights that cannot legally be excluded.
14. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Nothing in these Terms limits your statutory rights as a consumer.
To the extent permitted by law, we will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or losses arising from circumstances outside our reasonable control.
If you purchase goods wholly or mainly for business purposes, different legal rights and limitations may apply.
15. Personal Information
Personal information submitted through our website is handled in accordance with our Privacy Policy and Cookie Policy.
Please review those policies for further information about how personal data and cookies are handled.
16. Errors & Corrections
From time to time, website content may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, availability, delivery information or other details.
We may correct genuine errors and update website information where reasonably necessary, subject always to applicable consumer law.
17. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to our website, products, services, business practices or legal requirements.
The current version will be published on this page.
19. Governing Law
These Terms and any contract between you and 1st 4 Signs Ltd are governed by the laws of England and Wales, subject to any mandatory legal rights that apply to consumers elsewhere in the United Kingdom.
Nothing in these Terms prevents a consumer from exercising any rights they may have to bring proceedings in a court with jurisdiction under applicable law.
